Are you using either Vista or XP Media Edition? Both apparently have an issue with using the tilde ( ~ ) key in games.
Googling shows that there are people with this issue in two or three other games as well.
If you have a remote device for media control, disabling that drive seems to free up the tilde key. If you do not have a remote media device, there seems to be no reliable fix.. at least, not that I have found.
I have this same problem (Vista, regular keyboard, no remote media driver) and have not been able to resolve the issue.

Crap if you have Vista YOU cant open consoles in-game I cant find a fix!!
I had xp media before for oblivion which all I had to do is unplug the controller but this is a vista 64 and well you can see the problem.
So if we vista users try using console its impossible?! This is a vista compatable game for christ sakes.

I have vista and I can use the console no problem depending on your screen res you may not see the text it is in the bottom left corner. lower your screen res and see if it helps it did for me

it might be something to do with the windows instead; I had the exact same problem with oblivion on my vista laptop; I could not access the console there, but on my xp desktop, no problem!

It's not a screen resolution issue, the console isn't launching. If you attempt to enter a code as if the console were there and not visible, you just end up activating an in-game menu via hotkey (for example: god command launches rest/wait menu)
I've tried various resolutions both widescreen and 'regular', but it changes nothing.
It's clearly not affected all Vista users, but it's still very much affecting some Vista users. A quick google will give you page after page of hits about this issue for various games.
There's various things people have done to resolve this; however, no one resolution works for everyone.
I honestly have no clue what the underlying root cause of this is... but it seems to be tied to Vista and/or XP Media Edition.
But if anyone has a suggestion for a fix, I'm all ears. I'd love to get the console to function.

weird, i just press ~ and the console should pop up, look at your lower left corner if you're not sure if it's up or not
