I looked at using them before. But I remember something about game play vids. Basicly you need to hold the rights. If I remember right.

I have found out from some YouTubers I follow that a huge reason why videos are getting flagged currently is due to the "Content ID" bot going wild and flagging things that shouldn't be. According to YouTubers like Boogie2988, The people at YouTube have actually admitted that the bot is going wild, and they are working to fix it, but there is no ETA on when that will be completed.
