Each DX version supports all versions below. That means you should be able to install DX11 even if you can not use it.

How does the game let you know that you can't install it. Is there any error message?

As far as i know it should install but you can't run it if your system does not support DX11 and there is no DX9/10 version of the game.

the games install just fine the problem is the games wont start in cod i get error and with hitman nothing happens which is very strange by itself.
about the direct x installation it seems that even microsoft site identifies that my system support only dx9 and i cant seem to find dx11 install in that site, do you suggest that i'll download dx11 manually from other site and try to install it?

Hi there, Your 8800GTX doesn't support DX10 fully, only really uses Direct3D 10.

Also DX9,10,11 and 11.1 come in the same web installer app from MS.

so that means i must upgrade my gpu in order to run those games uh..

anyway i appreciate all your help thank you very much and if someone has any trick under his sleeve to bypass this gpu obstacle i would accept it gladly

You should be able to get a 650ti for quite cheap, plus get Assassin's Creed 3 with it for free (its a voucher code you use on Ubisoft's shop to get the game for free).
