Ok so I have finally decided to sell my banned xbox 360 elite. If i put it on ebay would i have to say it is banned in the description or could i just not say anything at all. If i did just say nothing at all am I actually doing anything wrong?

In a word: yes.
Why are you even bothering to sell such a thing?
It's kind of a paradox, if you put "banned xbox" in the description no one would probably buy it, but if you don't then that's false advertising and would single handily destroy your Ebay rep.

i would buy it beacuse they banned my credit card for no reason so i just play single player if its less than like 100 dollars that would be great.

If it got banned for being chipped I'm sure there is a market for that anyway. There are people out there who want a chipped console anyway and aren't interested in online.

You are required by the TOS to fully disclose the state of the product you are selling. If you don't say that it's banned, you'll get your sale voided and account flagged.
